Conditions of mediation service

Conditions for providing the online service

1. Scope

These conditions regulate the online contracting of the service of burofax notification, information session and preparation of a record of the mediation attempt, ofrecido a través de esta página web, en adelante 'el Prestador'.

2. Service description

The service includes:

• Writing and burofax sending with mediation proposal.
• Carrying out a information session on mediation with the requesting party.
• Issuance of record of attempted mediation, in accordance with Law 5/2012, on mediation in civil and commercial matters.

3. Price and payment method

The total cost of the service is €170 VAT included, which must be paid in full and in advance through the payment methods enabled on this website.

4. Service delivery conditions

• Once the contract has been formalized and payment has been received, the Provider will contact the client to start the procedure, send the burofax and schedule the session.
• The mediation information session must be held within a maximum period of three months must have passed from booking the service.
• If the session is not held within that period for reasons not attributable to the mediator, the right to it will be deemed to have expired, without any refund.
• For legal purposes, the mediation will be considered attempted and validly documented, even if the recipient of the burofax does not appear at the information session.

Refund Policy

1. Non-refundable nature of the service

• once the burofax has been sent, no cancellation or refund of the amount paid is permitted, regardless of whether or not the other party appears at the mediation session.
• In case of non-appearance of the applicant at the session, no refund will be made, except for justified reasons communicated at least 48 hours in advance.
• If three months from booking the service without the session having taken place for reasons attributable to the client (lack of response, lack of interest, unreasonable postponements, etc.), it will be understood that he/she renounces his/her right without refund of the amount.

2. Cancellations and rescheduling

• Requests to reschedule the session must be made in writing with at least 48 hours in advance. A new date may be offered within a period of three months.

Liability

• The Provider undertakes to carry out the agreed actions with due professional diligence.
• There is no guarantee that the party receiving the burofax will agree to participate in the mediation, nor that the mediation will be fruitful. The service is limited to facilitate attempted mediation, without this implying an obligation of result.
